Divorce and separation in Michigan is governed by many rules and Court procedures. The process can be long and confusing. A very good overview of the process can be found on the Michigan Family Mediation Council's website.
The Divorce Process in Michigan
Two documents must be filed with the Family Court in your County - a Complaint and the Judgment of Divorce. The couple is required to appear in Court only once - at the end when the Judgement is signed. If you have minor children, the mandatory time limit is six months. With no minor children, the divorce can be finalized after 60 days. The clock starts running on the date of filing of the Complaint.
The Judgment of Divorce will set out the rights and obligations of the couple after the divorce is finalized. Many important decisions will be memorialized in the Judgment of Divorce:
The Mediator will help the couple work out agreements on these and other issues. As stated earlier, the Judgment covers the post-divorce phase. An agreement is also typically worked out covering the time frame between filing the Complaint and the signing of the Judgment of divorce.
